EnergiHub Terms and Conditions
1) The EnergiHub services as described in these terms and conditions (the “Services”) offered by SSE Airtricity Limited (SSE Airtricity, we, our, us) in connection with the Energihub EV product (the “Energihub EV Product) to the customers (Customer, you, your) are cutting edge and are offered to the Customer as a beta trial (the “Energihub EV Product Trial”). As such, the Services are using the latest technology through strategic development and partnership, linking to the newly established smart meter infrastructure, which in some specific areas are still in the development stage. Our processes and systems in relation to the Energihub EV Product are often heavily reliant on and are subject to third parties providing accurate and timely data for us to provide the Services.
2) The Services are being provided to the Customer as part of a beta trial. Accordingly, the Services might not always be reliable. While Airtricity will always attempt to fix any issues through our partners in a commercially reasonable time, Airtricity makes no warranty, representation or undertaking in respect of such timelines and/or the availability of the Services due to circumstances outside of Airtricity’s control. To the maximum extent permitted by law, we disclaim all warranties whether express, implied or statutory in respect of the Services and the Energihub EV Product.
3) These terms are in addition to the General Terms and Conditions for the Supply of Electricity and/or Gas by SSE Airtricity Limited to domestic premises in the Republic of Ireland (“SSE Airtricity General Terms & Conditions”) and our privacy policy which can be found on our website at https://www.sseairtricity.com/privacy-notice/; together these terms and conditions the SSE Airtricity General Terms & Conditions and our privacy policy are referred to as (the “Agreement”).
4) By agreeing to take part in the Energihub EV Product Trial and availing of the Services, you hereby confirm that you understand and accept that the Services may not always work or be capable of being fixed in respect of the Energihub EV Product.
5) In addition to SSE Airtricity’s and the Customer’s liability in respect of the Services being limited in accordance with clause 19 of SSE Airtricity General Terms & Conditions, SSE Airtricity shall have no liability in respect of:
(a) any failure of the services provided by, or any acts or omissions of you, our partners and/or your car manufacturer; and
(b) any losses associated with unauthorised access, use, loss of, corruption to or alteration of any data in relation to the Services and/or the Energihub EV Product by you; our partners and/or your car manufacturer.
6) SSE Airtricity will use reasonable endeavours to provide the Customer with 30 (thirty) days’ notice in relation to the withdrawal of the Energihub EV Product. By entering into this Agreement, you recognise that the Services are being offered as part of a beta trial and as such, notice may not always be possible and may also be satisfied by a notice on our website www.sseairtricity.com.
7) SSE Airtricity or the Customer may terminate the Services on thirty (30) days’ written notice to the other party.
8) If SSE Airtricity ceases to provide your electricity for any reason or your smart meter reverts to non-interval readings, this Agreement will automatically terminate, and you will no longer have access to the EnergiHub app (as defined below).
9) While SSE Airtricity will use reasonable endeavours to provide you with 30 (thirty) days’ notice in relation to any variation by SSE Airtricity of these terms and conditions, by entering into this Agreement you recognise that the Services are being offered as part of a beta trial and as such, notice may not always be possible and may also be satisfied by a notice on our website www.sseairtricity. com and/or a message on your bill and/or statement.
10) Provided that the Customer has smart interval readings enabled and has opted for an SSE Airtricity smart tariff, the Customer will be eligible to download our SSE EnergiHub app (the “Energihub App”) through which you will be able to access the Services. New customers and existing domestic SSE Airtricity Electricity and Dual Fuel Customers (where Dual Fuel Customers both receive gas and electricity to the same address) are eligible to take part in the Energihub Trial.
11) If your premises does not have an eligible EV charger which can charge at a minimum of 7 kilowatts (KW), and/or does not have either a fully electrical vehicle (BEV) or plug in hybrid (PHEV) as listed on our website (https://go.sseairtricity.com/SSE-EnergiHub-Eligibility) that can be linked to the EnergiHub App, you will not be eligible to take part in the Energihub Trial and SSE Airtricity will not have the ability to provide the Services.
12) The tariff in respect of the Energihub EV Product (the “Energihub EV Product Rate”) will be preferential to your current tariff for the energy supplied to you in relation to the charging of your EV. The Energihub EV Product Rate will be valid until 31 May 2025 or until SSE Airtricity ceases this Energihub Trial in accordance with these terms and conditions or this Agreement. SSE Airtricity will use a combination of both (a) telemetry data from the Registered EV (as defined below) and/or the EV Charge Point (as defined below), and (b) smart meter data when applying the EnergiHub EV Product Rate. The EnergiHub EV Product Rate will be applied only to the first 7.4kWh per hour of energy used during the optimisation window of 23.00pm to 08.00am as scheduled by EnergiHub.
13) To enable the EnergiHub EV Product to function, you hereby consent to SSE Airtricity providing your EV charging device’s (the “EV Charge Point”) serial numbers to your hardware provider which will enable SSE Airtricity to receive telemetry data from your hardware provider(s) through data transfer. This data will be used to monitor, visualise optimisation and control your device in line with the Services you opt into within the EnergiHub App.
14) In addition to clause 13 you may be required to log into your existing applications, such as your EV application with your car manufacturer, to grant SSE Airtricity access to control your car (the “Registered EV)”. Without such access, SSE Airtricity will not be able to provide the Services and will not be liable for any such delay caused by lack of access to control the Registered EV.
15) Our ability to integrate, monitor the state of charge and control the charging of the Registered EV is also limited to what the manufacturer of the Registered EV and/or the EV Charge Point will allow within the limits imposed by their Application Programming Interface (API) and firmware. As such, EnergiHub is prevented from exceeding the operating limits set by your devices’ manufacturer. Accordingly, our control of when the Registered EV charges should have no adverse impact on the Registered EV or the EV Charge Point’s manufacturer’s warranty, however SSE Airtricity makes no warranty, representation or undertaking to this effect. Where there is an interruption, either intermittently or permanently from the Registered EV manufacturer or the EV Charge Point provider, SSE Airtricity will be unable to provide the EnergiHub optimisation.
16) To access the Services, within the EnergiHub App:
(a) the Customer must enable the AI optimisation function and set a schedule to advise when the car is required to be charged by and to what percentage state of charge. i.e. 80% by 08.00am; and
(b) the Customer must plug the Registered EV in after 16.00pm for SSE Airtricity to create a schedule for charging that same day. If the Registered EV is plugged in before 16.00pm and commences charging, SSE Airtricity will not be looking for the Registered EV. Accordingly, any energy used in this circumstance will be at your full tariff price.
16.1. Please note that SSE Airtricity is unable to override schedules held within other third-party apps which may impact how the Registered EV charges. To ensure the AI optimisation is possible, all other third- party app schedules should be disabled by the Customer.
17) Subject to you complying with clauses 14, 15 and 16, SSE Airtricity guarantees a minimum of 4 (four) hours charging per night where required to meet your desired state of charge at the Energihub EV Product Rate, provided that the Registered EV is plugged in, and a schedule is set. Additionally:
(a) where possible, SSE Airtricity may offer longer durations of charging to meet your desired state of charge. Should additional hours be provided where SSE Airtricity remain in control, these will also be at the EnergiHub EV Product Rate; and
(b) should only 4 hours be available and the Registered EV requires longer to get to the maximum state of charge, SSE Airtricity will not be able to meet your state of charge requirements and will stop charging after four hours.
17.1. Please note that optimisation times are defined as being between 23:00pm and 08:00am.
18)Customers that successfully sign up to the EnergiHub Trial and comply with their obligations to ensure that the Services can be provided as set out in these terms and conditions will be eligible for the credits in respect of the Energihub EV Product Rate which may be applied to their next SSE Airtricity open bill. For the avoidance of doubt, the application of the Energihub EV Product Rate will depend on the following criteria being met as determined at SSE Airtricity’s sole discretion:
(a) the Customer has EnergiHub’s AI Optimisation consistently turned on throughout day to day usage;
(b) the Customer has set up a schedule for charging the registered vehicle;
(c) the Registered Vehicle is charged at the Customer’s home during pre-defined optimisation times;
(d) telemetry data from the Registered EV and/or EV Charge Point is readily available for calculating the Energihub EV Product Rate;
(e) the Registered EV must respond to EnergiHub scheduling commands throughout each charging session; and
(f) the Customer has smart interval readings enabled and the Customer’s smart meter data is readily available for calculating the Energihub EV Product Rate that you can avail of.
19) The charging efficiency of the Registered EV may vary depending on the manufacturer. In some cases, the efficiency of the Registered EV may be lower than what goes through your meter. We will only credit against:
(a) the amount of consumption the Registered EV and/or the EV Charge Point says it has received, which in some cases will have to be calculated using information such as state of charge compared to battery size of the vehicle; or
(b) the first 7.4kWh of energy used per hour by You during the optimisation hours of 23.00pm to 08.00am when SSE Airtricity cannot obtain telemetry data during a given optimisation window.
20) Whenever the Registered EV is connected to a charger and charging away from the Customer’s registered home with SSE Airtricity, the Customer will not receive the Energihub EV Product Rate. Furthermore:
20.1 SSE Airtricity will validate charging against your smart meter. The amount of consumption through the Registered EV must always be lower than the total demand from your home to be eligible for the Energihub EV Product Rate.
20.2 Should you decide to boost charge the Registered EV on demand for immediate energy charging, you will pay your full tariff rate and the Energihub EV Product Rate will not be applied.
20.3 For the avoidance of doubt, the Energihub EV Product Rate will only be applied where SSE Airtricity has instructed the Registered EV to charge.
21) As set out at clause 16 (b), within pre-defined periods of the day, SSE Airtricity will poll the Registered EV for technical information (e.g. odometer, battery status, charging status) in order to identify when the car is plugged in and to ensure that it is only charging in line with the pre-defined schedule within the EnergiHub App.
21.1 Should the car start to immediately charge; any energy consumed before SSE Airtricity is able to stop the car will be charged at the full price. This could be up to 59 minutes’ worth of energy demand.
21.2 You understand and accept that SSE Airtricity polling the car may cause the car’s battery to discharge whenever the Registered EV is not in use. SSE Airtricity will only poll the Registered EV within the recommended manufacturer’s guidelines so as not to negatively impact the battery health.
22) Upon you selling the Registered EV, it is your responsibility to notify SSE Airtricity within 24 hours of the sale so that the Services can be terminated for the Registered EV.
23) We can enforce any rights and obligations under these terms and conditions and this Agreement even if there is a delay in doing so. If these terms and conditions are found to be unenforceable in whole or in part by any court of law or other regulatory or competent body, this will not affect any other part these terms and conditions and/or this Agreement.
